6. Your Choices and Privacy Rights

A. Marketing Communications

You may opt out of marketing emails at any time by clicking the unsubscribe link in the email.

Even if you opt out of marketing emails, you may still receive transactional or service-related communications.

B. Cookies and Tracking Controls

Most browsers allow you to:

We will acknowledge your request within 10 business days and respond within 45 calendar days. If we need additional time, we will notify you of the extension and the reason.

We may need to verify your identity before processing your request. If we cannot verify your identity, we may deny the request and notify you of the reason.

D. Authorized Agents

You may designate an authorized agent to submit a privacy request on your behalf. We may require the agent to provide proof of authorization (such as a signed written permission or power of attorney) and may require you to verify your identity directly.

E. Do Not Track (DNT) Signals

Some browsers transmit a Do Not Track (DNT) signal. We make best efforts to honor DNT signals by limiting non-essential tracking for users who enable this setting. However, there is no universally accepted standard for DNT, and we cannot guarantee that all third-party services embedded in our sites will honor it.

F. Global Privacy Control (GPC)

Where required by law, we recognize the Global Privacy Control (GPC) opt-out preference signal as a valid request to opt out of the sale or sharing of personal information. If your browser sends a GPC signal, we will process it as an opt-out request for that browser and device.

G. Texas Data Privacy and Security Act (TDPSA)

If you are a Texas resident, you have additional rights under the Texas Data Privacy and Security Act (TDPSA), effective July 1, 2024. In addition to the rights listed in Section 6C above, the TDPSA provides the following:

  • We do not process sensitive personal data (as defined by the TDPSA) without your consent. Sensitive data includes racial or ethnic origin, religious beliefs, health diagnosis, sexual orientation, citizenship or immigration status, genetic or biometric data, children's data, and precise geolocation.
  • We recognize universal opt-out mechanisms, including the Global Privacy Control (GPC), as valid opt-out requests under the TDPSA.
  • We process personal data for the purposes described in Sections 3 and 4 of this Privacy Policy. The categories of data we collect are described in Section 1. Some sharing with advertising partners may constitute a “sale” under the TDPSA (see Section 5).

H. Canadian Privacy Law (PIPEDA)

If you are located in Canada, your personal information may be subject to the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws.

  • We collect, use, and disclose your personal information with your knowledge and consent, except where permitted or required by law. You may withdraw your consent at any time by contacting us, subject to legal or contractual restrictions.
  • You have the right to access the personal information we hold about you, request correction of inaccurate or incomplete information, withdraw consent, and challenge our compliance with PIPEDA.
  • The AAM Group is responsible for the personal information in our possession, including information transferred to third parties for processing. We require third-party service providers to protect personal information in a manner consistent with this Privacy Policy.
  • If you believe we have not handled your personal information appropriately, you may contact us using the methods in Section 13. If you are not satisfied with our response, you may file a complaint with the Office of the Privacy Commissioner of Canada (OPC) at priv.gc.ca.

I. Appeals Process

If we deny your privacy request in whole or in part, you have the right to appeal our decision.

To submit an appeal:

  • Email us at sales@theaamgroup.com with the subject line “Privacy Appeal” within 30 days of receiving our decision
  • Include your original request, our response, and the reason you believe the decision should be reconsidered

We will review your appeal and respond within 60 days. Our response will include a written explanation of our decision.

If your appeal is denied and you believe we have violated your rights:

  • Texas residents may file a complaint with the Texas Attorney General at texasattorneygeneral.gov
  • Canadian residents may file a complaint with the Office of the Privacy Commissioner of Canada at priv.gc.ca
  • California residents may file a complaint with the California Attorney General at oag.ca.gov

7. Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this Privacy Policy. Specific retention practices include:

  • Account data is retained while your account is active and for a reasonable period afterward, or until you request deletion
  • Transaction and purchase records are retained as required for tax, legal, and business compliance
  • Marketing data (such as email preferences and campaign interactions) is retained until you unsubscribe or request removal
  • Analytics data is retained according to the settings of each analytics platform we use
  • Communications (emails, support requests) are retained as needed to resolve issues and maintain business records

When personal information is no longer needed, we securely delete or anonymize it. Retention periods vary based on the nature and purpose of the data, legal requirements, and business needs.

8. Cross-Border Data Transfers

The AAM Group is based in the United States. If you access our Services from outside the United States, including from Canada, your personal information may be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your jurisdiction.

By using our Services, you consent to the transfer of your personal information to the United States. We take reasonable steps to ensure that your personal information receives an adequate level of protection in the jurisdictions in which we process it.
